Letter To Authorities

I have been documenting physical abuse and neglect of my daughter, Samantha Heinzel, who is 4, for the past year. Jamie Heinzel for the past year has had full physical and legal rights to Samantha Heinzel. I am keeping a journal of those who have acted in hostile manner toward my child, and myself and now I must also, respectfully refer you to Title 18 and Title 42 of the United States code as they relate to the color of law. This journal also includes: the abuse, neglect and refusal of visitation. There are several police reports, Child Protective Services complaints, letters to Friend of the Court, 100's of documented bruises, testimony from the child to law enforcement, FIA, and friends about her father hurting her and now she has told FIA and Officer Bielas of the Rogers City Police Department that her father has sexually molested her. The only way a 4 year old child can talk about it. There have been 24 referrals to Child Protective Services and every one of them has been unsubstantiated even though there is testimony from police and the child as to what had occurred.
On December 4th, 2003 there was a forensic interview set up with 3 FIA workers and Officer Bielas and Samantha told them that her father had put his finger in her and pointed to her butt and vagina. She also disclosed many other physical abuse issues. FIA "forgot" to turn the volume on the video. John Keller, CPS supervisor, was running the video recorder. My husband and I were asked to take polygraphs in Grayling on this issue and I was lied to before the polygraph was even started. James ?? told me that Samantha never disclosed anything in my letter and she told CPS and Officer Bielas that her daddy put his finger in her stinky sock. Is this proper procedure in doing a Polygraph exam? I was very confused and upset before the polygraph even began.
CPS of Presque Isle and RCPD, Officer Kenneth Bielas are fighting over several issues.
If you look into this issue, you would find testimony of the State’s own employee of Family Independency Agency, Doug Gilmet, testified that the bruising he saw in pictures presented as evidence did lead him to admit such bruising would be considered as child abuse.
Did the court act upon this testimony? No. Did Child Protective Services act? No. Did the State Prosecutor, Gerald Gray, who is there as my child’s advocate act? No. Has the Prosecutor, who claims to be acting as my child’s advocate entered a Notice of Entry, to act as her Advocate? No. Did the Prosecutor act with unbiased attitude toward the State’s own employees? No.
This is sort of action is called favoritism, cronyism and ‘the good old boy’ network. Perhaps you remember the intervention a few years ago by your organization. Your investigation into this town found such activities occurring then as are occurring now. There has been an assortment of preferential fore ‘the homegrown boy’, an attitude of second-class citizen toward myself as well as those who try to support me, and utter disregard for the laws of the State of Michigan.
CPS and Gerald Gray, the assistant Prosecutor, were working together in May 2003 and filed that I am causing emotional abuse to Samantha because of the pictures and reports. Gerald Gray is supposed to be acting on behalf of my daughter and has repeatedly yelled most witnesses and Officers that were telling what Samantha had told them. It can be heard in the courts audio reports and also documented.
There is so much that is wrong here in Rogers City that it would take forever to type every instance out. I do feel that our Civil Rights have been violated by not using fair and unbiased personnel to conduct proper interviews and record statements fairly and properly. There is a lot of falsification in the Child Protection Services documentation. Even after Samantha disclosed the sexual abuse John Keller wanted to place Samantha in Jamie Heinzel's mothers care, Marylou Heinzel. Jamie's father, Mark Heinzel is known for his marijuana use, Jamie Heinzel, Marylou Heinzel, and myself testified to this in court and in depositions over a year ago. Samantha had sustained 3rd degree burns on her fingers in Mark Heinzel's care with the suspicion of him being under the influence of illegal drugs. Judge Kenneth Radzibon still placed Samantha in Marylou Heinzel's care even after this heard testimony. In Marylou Heinzel’s care, Jamie Heinzel threatened Samantha and told her not to tell about the sexual abuse again or he will grab and hurt her. I have a lot of Samantha's testimony on videotape on many different dates showing bruises and talking about other issues. She has been grabbing women’s breasts, saying, “I am just loving you” and touching herself inappropriately since February of 2003.
On December 2, 2003, Samantha fully disclosed that her father had in fact put his finger in her and pointed to her vagina and her butt. Lori Budnick of Child Protection Services told me in September of 2003 that even though I was writing letters to Jamie Heinzel about Samantha’s vaginal redness and pain when urinating that I am the only one who is witnessing these occurrences. So, for the court’s benefit I took pictures of Samantha with my digital camera that shows extreme redness in her vaginal and anal area since my husband was saying that he had no idea what I was talking about. 3 different times Samantha went in for an exam and there is no evidence of having an infection to cause such redness. The nurse practitioner, Tammy Henigan, when looking at these 2 photos did not exclude Sexual abuse. There were testimonies from Jamie, his mother, and girlfriend, Julie Looper, that no bubble bath or other irritants were used. So, why was she getting so red?
Samantha has told me that she has crawled into bed with her daddy and his girlfriend while they did not have clothes on and has witnessed many different acts that she is repeating. Then she also told the CPS workers and Officer Bielas what had happened to her. Presque Isle’s FIA unsubstantiated this referral, as well. Officer Bielas and Lori Budnick’s reports do not match and Officer Bielas is very upset with CPS for messing up his investigation by not taking notes and not turning the volume on the video camera. The Prosecutors office refuses to file a warrant on any of the physical or sexual abuse of Samantha. CPS, John Keller, is now filing Emotional Abuse charges against me once again because I took these 2 pictures to prove something was wrong with Samantha’s vaginal area. Doug Gilmet of CPS, says that these pictures are affecting Samantha’s self esteem. In my mind this is in Violation with Title 18, Sec. 241. - Conspiracy against rights. I have done everything I have been told to do yet, CPS and the Prosecutor’s office is failing to help this little innocent child and her abuse has escalated from physical into sexual.
I have had several problems with other officers not responding correctly or reporting accurately when they have been called to my house Matt Bisson, Jamie Meyer (he yelled at Samantha when she was going to tell him that daddy had hurt her on July 10th, 2003. I filed a complaint against him. His report also documented a dime size bruise and it was close to 2” in diameter) William Zinke (stated in the CPS report, he slandered me to FIA in January of 2003 said that I was not credible because I was arrested in a bar for a disturbance. This is a lie; I have never been arrested in a bar for any reason. His wife is Mike Vogler’s secretary, my husband’s attorney.)
Please contact me immediately on this matter. I was informed that I should contact your office in regards to these issues that are going on in Rogers City, Michigan. There is a lot more that has happened but these are a few of my main concerns. I don’t feel that neither I, nor my daughter has been treated justly by any of these organizations in this area. Anyone, I tell this too tells me that it is the Good ’Ol Boy Network and nothing will be done. Nothing has been and my daughter is suffering the most in this case.
