ABUSE, NEGLECT, AND VISITATION REFUSAL DOCUMENTATION:
On October 28, 2002, an Ex-parte granting Jamie full physical and legal custody was signed in effect by Judge Swallow. Samantha was removed from my home by police officer. It said that I was to be able to have visitation; I needed to be supervised with Samantha and that Jamie and I should work together to arrange it.
11/01/02 – Saw Samantha at Kortman’s, one hour.
11/05/02 – Saw Samantha at Karsten’s, one hour. Samantha’s fingers were severely burned.
11/08/02 – Saw Samantha at the Rogers City Library for two hours
11/15/02 – I sent my husband an email stating that he should write down a schedule that we can follow but he has refused. I saw Samantha at my house for three hours.
11/16/02 – Samantha at my house one hour
11/22/02 – Went to Rogers City Medical Group to view Samantha’s medical report on the 3rd degree burns on her fingers and Jamie had placed a note in Samantha’s file saying that I have no rights to view her medical records. Only reason she even went to the doctor is because I made the appointment since her fingers were red, cracked and sore. Immediate attention would have caused less pain for Samantha.
12/08/02 – I have noticed that Samantha is sucking her thumb. She has never sucked her thumb before.
12/09/02 - Judge Swallow remanded the Parenting Time matter to the Friend of the Court and we were told to follow their recommendations. There have been several times that I have documented where I was not allowed visits. Pages 47-49 of the Court Transcript discussed this matter.
12/10/02 – Samantha is becoming negative and was extremely tired. Marylou came to pick her up. Samantha became very angry at the site of her grandmother. She went over and began hitting her repeatedly and then kicked her in the leg. My mom tried to get Samantha’s boots on her but she laid on the floor and kicked her feet getting her boots off. It was clear that Samantha did not want to leave.
12/12/03 – When it was getting close to the time to go, I said, “Grandma will be here soon.” Samantha said, NO!! I am not going with Grandma. I am not ready to leave. She began to cry, fell on the floor and threw a tantrum.
12/14/03 – Samantha kicked, cried and screamed at her grandmother, Marylou, and told her “I don’t want you, Go Home!!” I looked at Marylou and said, “Sami are we supposed to act like that? Is that what Jesus would have you act like?” Samantha ran into my my arms crying, and she said, “No!” I said, “Sami, I love you very much and it won’t be long until you will be living with Mommy.” I hugged her and held her tight “Now, go with grandma and promise me that you will be a good girl for her.” She held tight. I hugged her again and told her, “ I love you baby-girl.” Samantha reluctantly left.
12/23/02 – I had called Jamie to ask him what we were doing for Christmas since it fell on an even day. I begged him to let me keep Samantha over night so that Grayson and Samantha could wake up together and experience Santa together. I said that I would bring her to his house at 10 a.m. He was very angry and screamed at me to open everything on Christmas Eve. And said that the Friend of the Court told him that he did not have to let me see her on Christmas if he didn’t want to and he hung up.
I called Friend of the Court and talked to Steve Obuchowski and he said that he would be granting a lot more time for Samantha, Grayson and I since Jamie was refusing to compromise.
12/24/02 – Jamie came to get Samantha. Samantha ran upstairs and would not come down. I had to physically pick Samantha up and pry her arms off of the banister of the stairs. She was crying. She wanted to stay with Grayson and I.
12/26/02– Samantha came to my home with severe red, puffy rashes between her legs. She was walking like she had been riding a horse; she was in a lot of pain. She was potty trained but now wetting herself at night and she was not being rinsed or cleaned up afterwards. So, the acid from the urine was eating and rubbing her raw. I put ointment on her before she went back to Jamie’s house.
1/03/02 – Jamie Heinzel and Julie Looper took Samantha to Burger King, which was fine but here in lies the problem, she wet herself in the restaurant and Jamie had to take her to K-mart for new clothes. That was what Samantha told me. Jamie on the other hand filled in the blanks and said he let her go to the bathroom by herself. The door was very heavy and had a hard time getting it open but finally did and did not make it in time. This is a public restroom why is he allowing a just turned 4 year old to go to the bathroom without supervision. I have to tell her not to touch the sanitary garbage cans in the bathroom because she wants to look inside. She would just sit on the seat without even knowing that there is urine or worse on it. The list could go on and on.
1/12/03 – Samantha came over with severe contusions on both of her legs. I had never seen so many deep bruises on her at one time before. So, I documented it. Samantha was never one to bruise easily.
1/16/03 – Samantha started to unbutton my mothers blouse and had a strange smirk on her face.
1/18/03 – Samantha came to my home with very red chaffing on the backs of her legs. She cried when I put ointment on her legs. I documented those as well and sent the photos to Doug.
1/28/03 – When Samantha was being picked up Jamie Heinzel, got angry and assaulted her by being extremely rough and grabbing her to the point of tears. He squeezed her left leg so hard that she cried out in pain. I called the RC Police Department and CPS and relayed what we saw happen and was informed by Officer Zinke that it was an assault, however due to the fact that there was no redness nothing was done. My mother and I both wrote out witness statements for CPS and the Police Department. I have copies.
1/29/03 – Officer Zinke called me and refused to allow me to file a complaint against Jamie Heinzel. He told me numerous times that it was not his job.
1/30/03 – Samantha came to my home and there were 3 bruises on her leg where Jamie had grabbed her. I called Doug and was very angry he told me to take her and get the bruises documented. We went to Cheboygan Memorial Hospital and documented them. Samantha didn’t want to go back to Jamie’s so, I took her to RCPD to get the bruises documented and once again I requested to file a complaint and Officer Zinke and Officer Bielas were both present. Officer Zinke once again told me no that it was not his job. They told me they would inform Jamie that Samantha was in a safe place tonight.
1/31/03 – I spoke to Gerald Gray and told him what was going on. He told me to file a complaint and I told him that RCPD was refusing to let me. He told me that it was their job to do that and I told him what Zinke said. He said try another agency. I then went to FIA to speak to Doug Gilmet to get Samantha removed from Jamie’s home and he looked at her leg and because the bruises were faint he said there was nothing to document. That the incident didn’t occur, he had the Chief of Police in his office with me to tell me that he was releasing Samantha back into the custody of Jamie Heinzel. I was furious and devastated.
2/01/03 - REFUSED VISITATION: Jamie refused to let Samantha come for her regular visitation to see her brother and myself for many days. On February 1, 2003 I went to Jamie’s home to pick Samantha up for our weekend and when she came running out to see me. Jamie screamed at her to get back into the living room. I have spoken to Samantha twice the phone. The phone was actually taken away from her on Tuesday night when she told Grayson and I that Julie Looper was in the home making heart cookies with her. It was about 8 o’ clock at night. My choice of visitation is either at the library which is very difficult with a 4 years old and an almost 7 years old because they want to play and get a little loud. Plus, she gets bored just sitting reading books, as much as, she loves me to read to her. Or, I can go to Mr. Heinzel’s home by myself to visit Samantha. I am afraid of Mr. Heinzel and would not feel safe going into his home alone even to visit my little girl. I feel like Jamie is playing mind games with me to see how far I will go to visit Samantha. I don’t think that it is fair that since he has temporary custody he can toy with me. I am very frustrated and hurt that he can do this.
I told my Counselor this at Shelter Inc. and she was outraged told me he is trying to control everything, which is very typical of an abuser, and to not play his games even if it means I don’t get to see Samantha until after court.
2/02/03 – It was court ordered that Samantha be allowed to attend church Jamie refused to bring her.
2/03/03 – Since I was refused visitation on the weekend I should have been able to see her on Monday and Jamie refused me visitation with her once again.
2/06/03 - Samantha Heinzel was invited over to her brother’s birthday party by mail invitation to have dinner and cake at 5:30 pm. Samantha arrived with Jamie Heinzel. Instead of dropping her off, he proceeded to sit himself on the couch and said that he was going to stay. I quietly said, “Jamie you are not part of this family anymore and this is no longer your home. Why are you going to stay and ruin Grayson’s birthday?” Jamie replied, “Well, I am not leaving.” I was in shock and devastated and asked, “Am I supposed to feed you as well?” He was acting like we were still a family. I had worked very hard on making a nice Pork Roast dinner with all the fixings, cake, ice cream, the works, to make Grayson’s day as special as possible. Jamie proceeded to sit on the couch like he was a welcomed guest. He refused to leave.
2/07/03 – Jamie did not bring Samantha over for her weekend. He took her to Canada instead.
2/09/03 – Samantha missed Sunday School. Wrote and sent Doug Gilmet a letter.
02/10/03 – Parenting Time again was addressed in court since Jamie Heinzel continued to not follow the Friend of the Courts recommendation. Page 4 starting on line 21 – page 8, line 8 in that Court Transcript. Judge Swallow said to follow the Recommendation strictly.
2/22/03 – Samantha had gotten her bath and as I was dressing her I noticed 2 bruises on her right leg. One was elongated about 2” to 3” in length like a finger and looked bluish in color. The second one was located at the top right side above her knee. The bruise was good size reddish brown in color. When I touched both Samantha jerked away and said OW.
2/24/03 – Samantha Heinzel vomited on Jamie Heinzel in his home.
2/25/03 – Samantha came to visit. Jamie said to me, “Samantha is complaining about her stomach but I don’t know whether to believe it or not.”
At 4:15 Samantha vomited an entire toilet full, it was bright pink and had a low-grade fever. I immediately called Jamie and there was no answer. His answering machine is no longer hooked up. I then called Marylou Heinzel and left a message with her. I told her that I don’t have his cell phone number any more. I told her that I could not take her to the doctor since I don’t have legal custody. The doctor’s office will not accept her if I bring her there. Her file states that Jamie has Full Custody.
Jamie called me after 5:00 and then proceeded to tell me that Samantha vomited in his face the night before after coming home from his mother’s house. He told me that she was fine all day. I said that since she had thrown up last night and today that I would not take her to school on Wednesday. I told him that she could be contagious and also the fact that she might catch it again or something worse with her immune system down. I said maybe she should go to the doctor’s office.
2/26/03 – I was sick with a fever and nauseous. I decided at 11:30 to make a trip down to Tots Aboard to check to see if Samantha was in school or home. I walked in and saw her snow pants and boots. I peeked in the classroom and there was no one inside. I walked to the gym to see if they were in there. I waited until I saw Samantha and walked in. It wasn’t until Samantha noticed me and screamed “MOMMY” and ran into my arms for a big hug that the teacher, Kelly Bruning, decided to come over and introduce herself. I said, “Hi, I just came by to check to see if Samantha was in school today since she was vomiting at my house last night and the day before. I am pretty concerned to see her here.” The teacher was silent and then hurried up and said, “Well, you would never know it…” I said, “Really. Samantha, did daddy take you to the Doctor today?” Samantha shook her head said, “Nope.” “Thank you, I love you baby-girl and I will see you tomorrow. Come give me a hug bye.” I said. And she did. I shook the teacher’s hand and told her it was nice meeting her.
2/27/03 – Samantha walked in the house and immediately complained to me that her stomach felt yucky. I gave her a big hug and asked if Daddy had taken her to the doctor and she said no. For dinner I made pizza; she ate very little. She looked very pale. Her stomach was rolling with Gas. She was almost in tears, saying that her tummy hurt her so bad. She had a lot of Gas and I took her to the bathroom and sat on the floor and held her hands while she went. She bent over and placed her head against mine. I rubbed her back and said, “Your going to be okay, Sweetie. I love you.” After she was done I wiped her up and she seemed to feel some better. But, she was not herself it was obvious that she was ill. I took pictures for documentation that she was ill. She sat mostly and put make up on my mom and me. Then I put make up on Grayson and Samantha. They wanted to be Indians. Samantha wanted to be Tiger Lily and Grayson wanted to be the Chief.
Samantha began looking down my shirt when I was holding her and then grabbing at my breasts. I told her to stop that. She had a weird smile on her face while she was doing that. Thought maybe she had see Jamie and Julie touching each other but had no idea.
When Jamie came to the door. I told him that Samantha had really bad diarrhea and that she probably should not go to school tomorrow. He did not want to hear anything I had to say. He said, “I don’t know what you are talking about she was fine all day today. She has been fine.” He was mad with me and carried her out to the car.
2/28/03 – I had to go to Alpena and on the way I stopped by Tots Aboard and Samantha was in fact at school once again while she was sick. I took pictures of her coat and boots that have a date stamp on them. Jamie Heinzel never took Samantha to the doctor. My mother became very ill that night.
3/1/03 – Samantha’s grandmother dropped her off at my house. Samantha still looked sick. She was running a low-grade fever and was very uncomfortable. I rocked her to sleep that night. At 4 years olds, she doesn’t usually let me rock her she wants to runaround and play so this showed that she was still sick. She had been sick for 5 days. Grayson began throwing up that night. Samantha also informed me that she doesn’t not like warm bath; that she runs her own water for her bath at her Daddy’s house. I said, “You mean you put the water in the bath tub?” She said, “Yep, Daddy lets me make my bath.”
3/2/03 – Samantha was feeling better so we went to Sunday school and church. My mom and Grayson stayed home since they were too ill to come to church. Jamie came to pick Samantha up and asked me how she was feeling. This proves that he knew she was sick and refused to take care of her properly.
3/04/03 - Samantha grabbed my mom and my chest again. Samantha pokes, and gropes at my breasts tries to unbutton my clothing. I tell her to stop that, that is not good for a little girl to be doing. Curious why she is doing that.
3/11/03 – I wrote Jamie a letter of concern because for the past 6 weeks Samantha has come to my house and has not been well. Samantha has had multiple fevers, runny noses, sore throats, diarrhea, and has vomited. I have documented all of these occasions. I had told Jamie numerous times verbally, face to face and the phone, about my concerns. But, still Samantha is ill and Jamie had not sought medical attention to help aid her in recovering.
3/16/03 – Jamie took Samantha with him to his bowling league from 6 until 9:30. I can say this with certainty since I used to work at Nautical Lanes on Friday nights that this is an inappropriate place for a 4 years old little girl to be. The guys are getting drunk, the horrible language, inappropriate behavior, plus the smoke is horrible in there. A little girl or any child should not be in this kind of environment. It’s no different from a bar.
3/20/03 – I wrote a letter to Jamie because Samantha appeared to be red and infected in her genital area. Told him to refrain from too many bubble baths may help.
3/23/03 – Jamie took Samantha to the bowling alley for his league, again.
3/25/03 - Jamie was very nasty with the children when they were showing him their new puppy.
3/26/03 - Jamie took Samantha over to Julie’s one room cabin for a sleep over. Samantha told me that she slept on the floor while Jamie and Julie slept in the bed… Julie lives in Ossenieke which maybe an hour from Rogers City. This confuses Samantha.
3/27/03 - Jamie dropped Samantha off this afternoon that he almost backed into her with his Honda Civic. He is mad because we have a new puppy that Samantha loves and it makes her want to be with us even more than usual. Jamie was mad and was trying to rush out of here as he usually does. But, this time Samantha was outside running around with the puppy and myself. We were walking towards the house and were very close to his car. Instead of waiting for us to get up to the house he started backing out. Samantha ran behind his car and I had to scream JAMIE STOP because he was still backing up with her behind his car. She was about 3” from being hit with his car. She even said, “Daddy almost hit me.” This really scared me. I cautioned her again about always watching for cars but this was really his fault and not hers.
3/28/03 – Samantha went to the bowling alley once again with Jamie.
4/1/03 - Samantha came to my home today and while she was trying on some clothes I had just bought her I noticed 3 bruises on her upper left leg. They were different from some of the other bruises one was elongated and the other had 2 bruises that were parallel like they were some what connected. The top bruise was not as blue and bruised as the bottom one. When asked where she had gotten them Samantha told me that Daddy had done it. I asked her when and she said yesterday. I asked why and she told me because I didn’t pick up my toys. I asked if Daddy ever spanks her and she said, “Once.” He grabs me hard. I asked does he do this a lot and she said, “Yes.” Does he get mad a lot? Yes, Mommy, you know. I asked her why she didn’t tell me this before. And she shrugged her shoulders. I asked her what else does Daddy get mad at you for? She said, “When I spill my drink in my food.” I said, “Samantha do you know that it is not okay for anyone to hurt you?” I honestly think that she thinks that what he is doing for discipline is okay.
I immediately called my neighbor to see if Samantha would tell her. So, Sally Warwick came over and Sally asked her similar questions and got the same answers. While Sally was here she told me that her husband said that we should call the Jeremay’s because he is a state cop. Kim Jeremay was Samantha’s Sunday School teacher she is who noticed and wrote the letter to the Psychologist about Samantha’s transforming behavior. Well, I called him and told him what was going on and he filled out a report and called Protective Services. Doug Gilmet from CPS called me and I told him what I saw and what Samantha had told my mom, Sally Warwick and myself. He told me that I needed to take her to a Doctor and get the bruises documented. I said I would but she won’t be home on time and I got in trouble with the court about this the last time. I told him that Jamie’s attorney said that he had said that I was filing false reports with his office and the Judge threatened to put me in jail. So, Doug assured me that he would call Jamie and tell him that Samantha would be home late.
As, Sally Warwick was leaving Samantha tried to unbutton her shirt and look down it.
I took Samantha to the ER in Cheboygan. The male nurse was looking at her legs and said that she had quite a few questionable bruises that didn’t really make sense. He said that bruising on the shins is normal but the other bruises like on the backs of her legs didn’t quite make sense. When I asked her to tell Dr. Feltman what happened to her leg she grabbed onto it and squeezed really hard. Officer Bielas came over to my house and talked to my mom and I at 11: 45 pm.
4/03/03 – I got Samantha and she showed me new bruises where the night before Jamie had grabbed her. There were two big bruises on her inner right leg by her knee. The one wrapped around to the back of her right leg. They were not very visible on the 1st. She also had a bruise on her right arm. I asked her how she got them and she said, “Daddy grab me.” I took several pictures. I sat Samantha down and I put a tape in our tape recorder and said I am conducting an interview with Samantha Heinzel on April 3, 2003. In the room is Lynn Sanderson, Grayson Sanderson, myself, Victoria Sanderson-Heinzel and Samantha Heinzel. The time is… I asked her all kinds of questions and she answered every single one of them truthfully.
4/04/03 – I wrote Doug Gilmet and my caseworker, Janelle Santini a letter and sent them pictures of the bruises. I told them that Samantha had shown her bruises to Sally Warwick and told her that her daddy had hurt her.
4/06/03 – Samantha was in my home and I took some pictures of her right arm she had severe bruising on her whole forearm. Appears to be a hand and finger marks. Samantha told my mom and I that her daddy got angry with her after she got home from the Hospital. Here is the result. I only caught part of the bruise on Thursday the rest did not show up until now and there was no redness in that area. I also found another long bruise under her left arm and photographed that as well. She said that Daddy did that yesterday. I am not sure what she was doing but she acted it out. Samantha told my mom today during naptime that Daddy hurts her a lot but not to tell anyone it is their secret. She also told me that Julie has hurt her too, but not in the new house.
Samantha ran up to her Sunday school teacher Peggy Thiemke and told her my daddy hurts me.
Samantha also told Jennifer Warwick her after Sunday school teacher that her daddy grabs and hurts her and she showed her teacher her bruises.
4/17/03 - I got Samantha tonight and once again she had bruises on her arm. Samantha does not bruise easily. When asked where she got them she told me that Daddy hurt her because she didn’t pick up her toys again. I called my neighbor who has not been involved in the other incidents. Samantha knows him well and knows he is a good daddy. So, we went over there for him to look at her. His name is Roger Budnick. He asked her all kinds of questions and she answered him. She even showed him how Jamie hurts her. When asked if she has been hurt before she said, “Yes”. She then grabbed both of her legs and squeezed. I asked Roger if he would be willing to write what he saw and witnessed and he had no problem with it. I documented those bruises as well. She had tattoos on the same arm so I am not sure if the bruising was covered up by the tattoos.
4/19/03 – Samantha came over and I noticed this very large bruise on her left upper thigh and a smaller bruise on her outer side of her left knee when I was getting her bath water ready. When I asked Samantha about the bruises she pointed to the one on her thigh and said that daddy squeezed her for not picking up her toys. Then she pointed at the other bruise and said, “But this one is from kid’s stuff.” And I said, “Kid stuff?” And she said, Yea daddy says that my bruises are kids stuff.” I said, “Oh okay but not this one?” pointing to the bigger bruise. And she said, “No, daddy did it.” So, I took some pictures of the bruise after her bath.
4/24/03 – Samantha told me that her daddy was grabbing and squeezing her feet. I asked her why and she said because he is being mean to me.
4/26/03 – I got Samantha for the weekend, my boss, Patrick Keyes had come up to discuss business with me and invited the children, mother and I to come to the hotel so, the children could make use of the pool while Pat and I worked. While getting Samantha’s swim on off of her I saw the extreme rash between her legs, she also had some bruising on her ankles and feet, and a bruise on her the back of her left thigh. I photographed her in front of my boss as a witness.
4/27/03 – Getting Samantha ready for church I noticed that she had terrible bruises on her right elbow. I asked her how this happened and she said, “Daddy hurt me, again.” After church I asked Patrick to look at her arm he asked her out of general concern, “what happened?” Samantha replied, “Daddy” and she grabbed and squeezed her elbow as hard as she could, gritting her teeth. I photographed her elbow and ask Patrick if he would feel comfortable writing out a statement for me for Child Protective Services.
5/03/03 – I saw a bruise on Samantha’s right upper thigh. When I asked how did that bruise happen she told me that she did not pick up her toys, so her daddy grabbed her.
5/04/03 – Sent a letter home to Jamie about Samantha being red and irritated in the vaginal area. There was not a rash; but it was infected up inside her and very noticeable when I put ointment on her. I did not want to take a picture decided to write a letter instead. In the letter I gave Jamie several ideas on how to reduce the redness and rashes. I also told him that Samantha had coughed all night was feeling rotten, that I had given her some cough suppressant. I said that if it persists, that he should take her to the doctor to get looked at.
5/06/03 – Samantha was extremely ill when she came to my house. She was very lethargic and laid in my lap so I could rock her. She was running a low-grade temperature of 99 degrees. I wrote Jamie a letter saying that I was concerned. Samantha told me she had gone to school the previous day so, I thought I had better reiterate the fact that she was sick once again and probably should not go to school.
5/08/03 – I had bought Samantha some new clothes and was trying them on her. I noticed this huge bruise that was towards the top of her back right thigh. I turned her around and saw a small bruise on the top right thigh. I was perplexed that it ran parallel to the bruise on the back of her thigh. I asked Samantha, “How in the world did you get this boo boo?” She said in a sad voice, “My daddy grabbed me.” I said, “What are you doing that he is grabbing you?” She said, “Because I didn’t pick up my toys again.” I told her that she really needed to obey her daddy so that she would not get hurt anymore. She showed me another bruise on her leg by her knee and said a table hurt her there not daddy. I smiled and said, “What a bad table. Did you tell it not boo boo your knee anymore?” And Samantha giggled and said, “Mommy…”
When Jamie came to pick Samantha up I said to Samantha remember to listen to daddy and pick all your toys up so that he will stop hurting you. I wanted to make a point that I knew what was going on. Jamie got extremely angry with me and sped out of the driveway and honked the horn repeatedly about 4 times.
5/10/03 – Samantha came to my home for her overnight. She had two different sets of bruises on her left and right arm. On her left arm there was a bruise and a nail mark on her arm. Jamie bites his nails. So, I knew the nail mark was not from him. Then on the right arm there was a faded long bruise that was about 2” to 3” in length and one that was a little more noticeable right above it on her arm. I called Sally Warwick over to have her view Samantha’s bruises again. When asked Samantha told Sally that Julie had hurt this arm pointing to her left arm. “She put her nail in me,” Samantha said. And then Samantha proceeded to tell Sally that Daddy had grabbed the other arm. When asked why she said she had broken a glass. I photographed her bruises.
5/11/03 – Samantha showed Jennifer Warwick her bruises and told her that Julie and Daddy had hurt her. I decided that I needed to have these documented so I called RCPD and had an officer come out. It was Officer Bielas, he spoke to Samantha and she reluctantly told him what was going on. It was very apparent that she was scared. She told Officer Bielas that she was alone with Julie when Julie had hurt her.
I wrote Jamie another letter stating that Samantha was still sick with a cough and runny nose. I told him that Samantha had confided in a few people that Julie and her daddy had both hurt her. Also, that there should be no reason why Julie should even touch Samantha much less injure and leave bruises and scratch marks on her. I told him that no form of discipline should ever leave marks much less severe bruising. Samantha does not deserve to be treated like this but deserves to be loved.
5/12/03 – Doug Gilmet came out to my house to follow up from April 26th and 27th. He wanted to speak to Grayson. So, I called Grayson into the room and Doug refused to talk to Grayson in my home. Doug said, “He needs to be interviewed in my office.” I said, “That’s fine.” I proceeded to tell Doug about what Samantha had said over the weekend and described the bruises and told him that Samantha had talked to Officer Bielas, Sally Warwick, and Jennifer Warwick. Plus told him that I had taken pictures.
I sent a letter to Doug Gilmet and some of his supervisors that outlined what had been happening. I told Doug that I talked my attorney and that he said that Doug could interview Grayson only if he either audio or video taped it. I asked Doug to please help Samantha.
5/13/03 – Took Grayson in to see Doug at 2:30p.m. I brought Kellie Wang and my mother with me as witnesses. Doug came out and told me to come into his office. He told me that absolutely under no circumstances would he tape his conversation with Grayson. That he talked to his supervisor Mr. Parrot, I believe his name was and that because of the Child Protection Act he didn’t have to. I said, “Well, if you are going to talk to Grayson you have to tape it. Or you can have Kellie come in and observe.” Doug got very mad at me and said that he would then call the Prosecutor. I said, “Do whatever you have to do but you are not talking to Grayson without it being taped this is protect him, as well as, you. And by you not allowing it to be taped doesn’t make you look very good. What do you have to hide?” He called Gerald Gray and made an appointment with him at 9:30 in the morning for a meeting. Doug then asked me if I was getting Samantha today. And I said, “Yes, I am.” And he repeated himself and said, “You get her today?” and I said, “Yes, I do at 4:00p.m.” Then I walked out and left.
At 4:15 Samantha did not come to my house. So, I asked Kellie Wang to come with me to go to Jamie’s home on 425 North First Street to see what was going on. No one was home. I then decided to take a trip down to FIA. Jamie Heinzel’s Honda Civic was park in the parking lot. Kellie Wang and I went inside. The secretary asked if she could help me I said, “I am here to pick my daughter up, Samantha Heinzel.” Soon after, Doug Gilmet, Jamie Heinzel, and Samantha Heinzel all came out of Doug’s office. Doug told me that I would not be allowed to take Samantha back to my house until I get in touch with the Friend of the Court and get a new supervisor. I said, “Well, what about Kellie can she supervise today?” Jamie said, “No, make an appointment with the Friend of the Court.” I went over and gave Samantha a big hug and Doug rolled his eyes at me and felt that he treated me with distain and disrespect.
5/15/03 – I was refused Parenting Time. Jamie would not return my phone calls.
5/17/03 – 5/18/03 – I was refused my Saturday and Sunday with Samantha. Since Jamie didn’t allow me a full weekend every other weekend. I was granted limited phone conversations with Samantha.
5/20/03 – Filed a Parenting Time complaint with the Friend of the Court. Jamie once again refused Parenting time with Samantha. I asked if we could meet at the Library and he said, “No, because he didn’t want to be there. He began yelling at me on the phone and after awhile I hung up on him.”
5/22/03 – 5/28/03 – I was refused any kind of Parenting Time with my daughter other than brief phone conversations. Most of the time I called Jamie Heinzel refused to answer his cell phone and when I did get to talk to Samantha she asked all sorts of questions. I asked her if her daddy wanted her to ask me all these questions and Samantha said, “Yes.” Our new Judge issued a Temporary Parenting Time Order.
5/29/03 – Samantha came to my home very sunburned and had 3 sets of new bruises that were odd. Two on Samantha’s left thigh, one big, long bruise on her right arm, and a deep bruise on her left outer fleshy part above her elbow. When asked Samantha said, that her daddy had hurt her pointing to each of these bruises. She pointed to the elbow bruise and said, “Daddy grab me, I spill my drink.” Then she pointed at her left elbow at the scrape and she said that she had fallen on daddy’s carpet, that daddy didn’t do that one.
I sent a note home saying that he needs to put sunscreen on her if he is taking her out in the sun. I explained that children have very sensitive skin and it damages easily.
In June, I don’t remember the date I gave Officer Bielas a videotape with Samantha talking about her bruises and abuse. In one of the reports that he had filed on Samantha, Samantha told him that she had broken a glass at daddy’s house and he hurt her. In one of the video segments Samantha says, I BROKE ANOTHER GLASS. I also included many pictures. He wrote an extensive report about 7 pages in length.
6/1/03 – During Church, Samantha showed Jennifer Warwick her bruises on her leg/thigh and told her that her daddy hurt her.
6/03/03 – We went over to our neighbor’s house for Samantha to play with Sarah Wang. While we were over there, Samantha told Kellie Wang that her Daddy hurts her.
I picked Samantha up while I was making dinner and she yelled when she wrapped her legs around me. I said, “What’s wrong?” She said, “I peed the bed again.” I took her into the bathroom and checked her legs. She was raw and had a severe rash. I took pictures.
I wrote another note home to Jamie about her rashes again.
Samantha was invited to play on June 5th with her friend Brooklyn I asked Jamie if she could go. He ignored me.
6/04/04 - I called Jamie to asked about Samantha playing with her friend. Jamie got very angry at me and told me that if I wanted to get her early that day I would have to contact the Judge and get it changed. I said you mean you won’t allow me to have from 2:30 to 6:30 so that she can play with her friend? He said absolutely not. That there is a court order and we have to follow it strictly. I said, “Well you have never followed an order yet, why can’t you be flexible.” He again refused. I said, “Jamie it will not look very good for you if we can’t work together. How is this good for Samantha if she is not allowed to go play at her friend’s house and you won’t let her just to spite me.” He was very angry with me and yelled, “Call the Judge and change it in court” and hung up on me.
6/05/03 – Samantha was invited for a play date with her friend Brooklyn Warwick. Jamie refused to let her go.
6/07/03 – Samantha’s face and arms were sunburned again. When asked if Daddy put sunscreen on her she said, “No.”
6/08/03 – Jamie gave me a new address for Samantha and him. 779 S. First St. and new phone number 734-2253. This is the 3rd residence that Samantha will have lived in since October 28, 2003.
6/09/03 - Samantha is now wishing on a star from Pinocchio that the Fairy will grant her a wish and that wish is to send her daddy far away and let her live with mommy and Grayson in Florida.... this went on for about 2 hours tonight. She came up with this scenario all by herself. She thinks that this Fairy is going to make her wishes come true. She watches Pinocchio at Marylou Heinzel’s house. I do not own this video. I encourage Samantha to pray.
6/10/03 – I wrote a letter to Jamie asking him if he would like some time with Samantha on Father’s Day.
6/12/03 – Wrote a letter to the Friend of the Court showing how inconsistent Jamie was when the Parenting Time benefited him. “Father’s Day” he readily changed her visitation time so that he could see Samantha. Samantha was also complaining that Julie Looper is very mean to her. This is Jamie’s girlfriend.
6/19/03 – Received a schedule and letter from Jamie telling me that he was taking Samantha out of the state from July 11th – July 20th for a wedding. I wrote a letter to Jamie expressing my concerns and telling him that I did not agree with him taking her and refusing me my parenting time. I just repeated what he had been saying about following the court order. I told him that I didn’t feel that it was in Samantha’s best interest to be separated once again from me for weeks at a time. Bruises on Samantha in a pattern above her right knee and on her right elbow. I took pictures. She told me that daddy had grabbed her.
6/21/03 – Jamie wrote me a long letter telling me he has never tried to keep Samantha from me. He asked me not to put diapers on Samantha. That it doesn’t help Samantha’s self-esteem. I use Pull-ups on Samantha. She was potty trained back in October 2002 and regressed to wetting the bed when she moved in full time with Jamie. He brought up the Ex-parte order why I have visitation and talking about his trip to New Jersey.
6/23/03 – Vacation Bible School, Samantha came in dirty shorts and a dirty shirt. Jamie knows that the women and girls always wear skirts or dresses to church. I was embarrassed. Samantha rode the bus to church.
6/24/03 – Samantha came to my house and was dressed inappropriately. She was wearing a string top that showed her chest. She also had severe sunburn after telling him to make sure and put sunscreen on Samantha. So, I took her upstairs to change her. I noticed that her underwear was on backwards and when I helped her step out of them to turn them around I noticed that she smelled really bad. She had feces caked in her underwear and on her bottom. It showed that her underwear was on backwards. I took her to the bathroom and gave her a quick bath and changed her clothes. I also noticed she had a bruise about 2 inches above her knee. She told me that daddy hurt her and then told her that I had done it. I kept Samantha’s dirty underwear. I wrote Jamie an extensive letter. I took pictures of the bruise on leg, clothes, underwear, and sunburn. I videotaped her.
6/29/03 – Samantha came to my home with multiple bruises on her arms. On her right arm there is elongated bruises in a pattern. Samantha told me that Jamie grabbed her. She also had multiple bruises on her left arm. I noticed after I gave Samantha a bath and got her ready for bed that she had 3 or 4 bruises on the backs of her right leg. It looked as though someone had grabbed her, pressure points from fingers.
7/08/03 – Samantha came to my home with a bruise on her left buttocks. She told me that Jamie had hit her.
7/10/03 – Samantha came to my home with multiple bruises and told me that her father, Jamie Heinzel, had hurt her. I asked the dispatcher to please send someone over to document these bruises. Officer Jamie Meyers responded. He came up my steps and said, “Someone called and needed me?” I said, “Yes, my daughter came to my home with bruises and said that her daddy had hurt her. I need you to view them and document them.” Samantha was in my arms clinging to me hard and refusing to look at Officer Meyers. I turned her and showed him the bruise on her Right thigh and Left thigh. He said very loud and sternly, “How do you know he did those, she could have run into anything?” I look at him and said, Samantha told me that he did them that is how I know.” He then yelled, “Samantha! Is that true?” She clung even tighter at the raise in his voice. Officer Meyers only took pictures of Samantha’s right leg but refused to take pictures of her left leg.
Samantha told mom and I that she finally told Doug Gilmet that Daddy hurts her, that she was scared but she told him, anyways.
7/12/03 – I wrote a letter of complaint to the Chief of Police, in regards to Officer Jamie Meyer’s behavior toward Samantha.
7/15/03 – Wrote another letter stressing that I did not agree with Samantha leave the State with Jamie.
7/16/03 – 7/20/03 – Jamie took Samantha out of the State. Violating the court order for visitation.
7/22/03 – Samantha came to my house with no bruises at all.
7/24/03 – Samantha had a elongated horizontal bruise on her right leg and an elongated vertical bruise on her left leg. Samantha said that daddy had gotten mad and hit her. I took pictures.
7/27/03 – Officer Joseph Daniels came over and documented an elongated bruise on Samantha’s right leg. Samantha told Daniels that daddy slapped her. She told us that daddy hit her with the side of his hand when he was mad.
7/31/03 – Samantha came to my home with a hickey on her arm. I asked her what happened and she told me that daddy sucked on her. Officer Bielas came over and documented it. I took a picture. Samantha began to suck on my neck with Officer Bielas in my home. Samantha told Kelly Wang and Sally that daddy did it.
8/02/03 – Samantha had a large elongated bruise on the back of her left leg. She told Officer Daniels that daddy had grabbed and hurt her. Called Sally to come over.
8/14/03 – Samantha had a large bruise on her right thigh towards the buttocks, and a smaller bruise on her lower thigh about 4 inches away from the other bruise. Samantha said that daddy hit her. Officer Bisson came out and documented.
8/16/03 – Samantha came to my house and she was complaining about how sore she was in her vaginal area. I looked and she is very red and infected. I wrote a letter to Jamie trying to help him in out with bathing Samantha. Samantha told mom and I that Julie was hitting, grabbing and hurting her.
8/24/03 – Wrote a letter to Jamie addressing Samantha’s schooling, that we should talk about what we were going to do since he was working, that it should be a Joint effort. I got no response from Jamie.
8/28/03 – Jamie cut Samantha’s hair after I had asked him repeatedly to let it grow long. Samantha cried. Jamie told me that he was taking Samantha to a wedding reception and would not bring Samantha on Saturday until 8 o’ clock.
8/29/03 – Jamie and Samantha spent the night at Julie’s house. He lives less than a mile away.
8/30/03 – Dropped off an extensive letter to Jamie at Julie’s house at 9 a.m. about school, about the reception, about Samantha’s haircut, and how he never responds to me when I ask him questions or have concerns. I asked Jamie to bring Samantha to my house at 6p.m. instead of 8p.m. that she didn’t need to be around all that alcohol. His family drinks a lot.
Samantha was also very red in the vaginal area. Samantha had a bruise on her back that she told Sally Warwick, my mother and I that daddy hit her in the back with a brush. She also had 3 bruises on the back of her leg where she told us that daddy had grabbed her.
8/31/03 – Wrote Jamie a letter expressing concerns that Samantha is red in the vaginal area, concerns that Jamie is having sleepovers again with Julie and that it is teaching Samantha immoral behavior, asked him about the bruise on Samantha’s back and leg and wanted an answer as to how she got it. Jamie never responded to me.
9/01/03 – The Office of Children’s Ombudsman decide to investigate Children’s Protective Services. Wrote a letter to John Keller, CPS supervisor, telling him about the bruise on Samantha’s back giving him the opportunity to investigate. Also, giving him a few concerns that I had in the CPS report that he had sent me.
9/13/03 – Samantha has a pattern of bruises on her back. Samantha told us that Daddy had hit her. She also had a big bruise on her left buttock where she said daddy had hit her. Samantha told me that Daddy had sold our GMC van.
9/22/03 – Samantha came to a Prayer meeting and told everyone there that Daddy hurt her. Officer Daniels came to take the report; I ran out of buy some film. Samantha slapped mom in the face when he asked her how Jamie had hurt her. Mom had picked Samantha up. So, Samantha showed Officer Daniels with her hand. He refused to talk to the people in Sally Warwick’s house, that witnessed Samantha say that daddy hit her. Officer Daniels said that Samantha told him Jamie hurt her. He said that didn’t need anyone else’s testimony. He also said that Samantha had hit my mom when he asked her how daddy hurt her.
10/04/03 – I wrote a letter to Jamie asking him to have his mother or himself bring Samantha out to my work since I was unable to leave work.
10/05/03 – I wrote Jamie another letter complaining that her vagina is very red. Jamie was also dressing Samantha in short sleeve shirts and a raincoat when the temperature was in the 30’s. Jamie told me no, he would not drop Samantha off at my work. He said to have my mom pick Samantha up. I said that she can’t and then he told me that if she is not going to be there I don’t get to see Samantha. And that if it was up to him he would not have allowed my mother to supervise in the first place. He told me that I had to find a supervisor or not see Samantha. He told me that he would not let me see her and if it were up to him that my mother would have never supervised in the first place. Jamie said, that my mother has no business being around his daughter. Jamie said, “If it were up to me you nor your family would ever see Samantha.” Samantha heard all of this and was very upset and crying. He slammed the truck door and refused to let her hug me bye.
10/06/03 – I called Jamie Heinzel and tried to discuss Visitation with him. I asked him if Mi Chung Malone could supervise. This is a member of our Church she is a friend of our family. She and Samantha have a very good relationship. Jamie started yelling at me telling me that he talked to the Friend of the Court and that Teresa told him that he didn’t have to let me see Samantha if he didn’t not agree to the supervisor. I said, “Mi Chung is a lady in her 50’s.” Jamie cut me off and said, “I don’t know who she is.” I said, “Yes, you have seen her at my house several times and in court with me. So, you are telling me that I am not going to be able to see Samantha before court on the 15th? Jamie told me, “It is not his problem.”
10/07/03 – Samantha went to school after she had thrown up 3 times at Jamie’s house. Samantha was very sick at my work and almost threw up there. Jamie always takes Samantha to school when she is sick unless I protest. I wrote Jamie a letter telling him not to take Samantha to school when she is throwing up. I asked Jamie to make 2 copies of the letter that he made Mi Chung sign. He never did. He was very rude to Mi Chung and the kids. I had to bring all 6 children into Rogers City to pick Samantha up. Mary Lou was there she could have dropped Samantha off, but they refused to be helpful. The children actually said that Jamie has the devil in him, because his attitude was so nasty.
10/09/03 – Jamie “forgot” to pick Samantha up from Montessori. I sat with a van full of 6 children for 30 minutes waiting for Jamie to arrive with Samantha. . I called PICH and asked if Samantha had been picked up yet. They told me no. I then, had to call Tendercare looking for him. I called at 4:15 pm. He was very aggravated with me that I called him at work. I merely said it’s after 4:00 and Samantha is not here, can I meet you at her school to pick up. He said I will be right there with her and hung up on me. She pulled in after 4:30 p.m. The nine year old child made the comment that Jamie had the devil in him he could see it in his eyes. I thought that was interesting seeing I did not say anything about Jamie before. This threw our whole dinner schedule off, as well as, everything else. When he picked Samantha up I asked once again for a copy of the paper that Mi Chung had signed. Jamie told me that I have a blank one that I don’t need a copy of the signed paper. This upset Mi Chung because if she signed something she wanted a copy of what she put her name on. Jamie outright refused.
10/21/03 – Samantha came to my house with multiple bruises on the back of both of her calves. Samantha told Sally that daddy hurt her. Samantha also told Sally that Jamie tells her everyday before school that if she tells mommy or her teacher that he hurts her that he is going to hurt her more. I wrote a letter requesting Jamie to please tell his mother, or as I still call her mom, to please not feed Samantha Subway or Little Caesar’s before dropping her off. This kills her appetite for dinner and I always cook a rather large dinner when she comes over and she can’t enjoy it.
10/22/03 – I left a message with John Keller of CPS telling him to contact Sally Warwick.
10/23/03 – Samantha came to my house with a fever and sick. She told me that she was sick that morning and didn’t want to go to school and Jamie forced her to go. I gave Samantha an oil treatment and I wrote a letter to Jamie telling him that I would watch her if he needed someone to since she is very sick. I asked him to please let me know one way or another. He never called.
10/26/03 – Samantha hid behind the couch when she heard her daddy pull in the driveway. She didn’t want to go with him. She came to my house with her anal area very red and irritated. She was fussing and complaining asking for medicine. I don’t think she tells Jamie anything. I doctored her.
